B. ACTION FOLLOWING RECEIPT OF A VALID INFRINGEMENT NOTICE

After receiving a complete and good-faith infringement notice, Printscozy may take appropriate action, including:

  • Reviewing the allegedly infringing content;

  • Removing or disabling access to the disputed content where appropriate;

  • Contacting relevant parties for additional information;

  • Notifying the party responsible for the affected content, where applicable; and

  • Taking appropriate action regarding repeated or serious infringement.

Printscozy reserves the right to remove content or products that we reasonably believe may violate applicable intellectual property laws or the rights of third parties.

C. COUNTER-NOTIFICATION PROCEDURE

If you believe that content was removed or disabled as a result of a mistake or misidentification, you may submit a written counter-notification.

Your counter-notification should include:

  • Identification of the content that was removed or disabled and the location where it appeared before removal;

  • Your full name, mailing address, telephone number, and email address;

  • A statement, made under penalty of perjury, that you have a good-faith belief that the content was removed or disabled as a result of a mistake or misidentification;

  • A statement that you consent to the jurisdiction of the appropriate United States Federal District Court as required by applicable law and that you will accept service of process from the person who submitted the original infringement notice or their authorized agent; and

  • Your physical or electronic signature.

Where applicable under the Digital Millennium Copyright Act (“DMCA”), we may provide a copy of a valid counter-notification to the original complaining party.

Unless the complaining party informs us that legal action has been filed seeking a court order regarding the disputed content, eligible content may be restored in accordance with applicable law.

D. TRADEMARK AND OTHER INTELLECTUAL PROPERTY COMPLAINTS

Printscozy also reviews complaints involving trademarks, trade dress, publicity rights, and other intellectual property rights.

If your complaint does not involve copyright infringement, please provide sufficient information to identify:

Supporting documentation may be requested where necessary to evaluate your claim.

E. FALSE OR MISLEADING CLAIMS

Please note that submitting a knowingly false or misleading infringement notice or counter-notification may result in legal consequences.

Under Section 512(f) of the Digital Millennium Copyright Act, a person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages as provided by applicable law.
